Fysigo Legal
Version 2.0 · Effective 2026-10-16
These Terms govern your access to and use of the Fysigo platform — the websites, mobile apps, APIs, and related services operated by Fysigo. By creating an account, buying a membership, or using any part of the platform, you agree to be bound by these Terms.
Please read Section 15 carefully. It requires disputes to be resolved by binding individual arbitration, not in court, and waives jury trials and class actions.
Fysigo is operated by Guten Group US Holdings, Inc., a Florida corporation (“Fysigo,” “we,” “us”). Our mailing address is 850 E Lime St, P.O. Box 1057, Tarpon Springs, FL 34689, USA. “You” means the person using Fysigo, or the parent or guardian who accepts these Terms for a minor as described in Section 3.
Fysigo is an information-management platform that lets coaches and their clients organize health, training, recovery, bloodwork, nutrition, and related data in one place. The platform is not a medical service, a diagnostic tool, a telemedicine product, or a substitute for professional medical advice. Fysigo does not provide medical, diagnostic, or treatment services, is not a healthcare provider, and is not a HIPAA covered entity or business associate.
Information surfaced through the platform — including spectrum scales, reference ranges, agent briefs, and any computed summary — is informational only. Always consult a qualified healthcare provider before making decisions about your health.
You must be 18 years or older and legally capable of entering into this agreement to create an account. By signing up you confirm both.
You agree to give accurate information and keep it current. You are responsible for keeping your login credentials secure and for all activity under your account. Tell us at once at support@fysigo.com if you suspect unauthorized use.
Every Fysigo account is a paid membership. There are no free accounts and no free trials. Before you buy, we show the price in US dollars, how often you are charged, and what the membership covers.
Your membership renews automatically at the end of each period, at the price and for the period shown when you bought it, and your payment method is charged on each renewal until you cancel. If the renewal price will change, we tell you before the renewal on which the new price applies, and you can cancel before it does.
How to cancel. Cancel any time in Fysigo under Billing. If you subscribed through the Apple App Store, cancel in your Apple account’s subscription settings; Apple’s terms govern that purchase. Cancellation stops the next renewal; you keep access until the end of the period you already paid for. Payments are non-refundable, including for partly used periods, except where the law requires a refund or we say otherwise at the time of purchase.
Coach offerings. Coaches can sell programs, packages, sessions, paid groups, and add-ons through Fysigo. The coach sets the price and what is included. A recurring coach offering renews automatically at the price shown until you cancel it in Fysigo under Billing, on the same terms as above. Group-session cancellation windows are shown at booking.
Payments are processed by Stripe (and Stripe Connect for coach payouts), or by Apple for App Store purchases; their terms also apply. If a payment fails, we may retry it and may pause access until it succeeds. Prices do not include taxes unless stated; you pay any taxes that apply. Coach payouts are governed by the Coach Acknowledgement.
Coaches who use Fysigo with clients are independent professionals and not employees, agents, or representatives of Fysigo. Coaches are solely responsible for the advice and services they provide to clients. The detailed acknowledgement is set out separately in the Coach Acknowledgement, which forms part of these Terms for users acting as coaches. Your dealings with a coach or another member are between you and them; Fysigo may, but need not, help resolve a disagreement.
You agree not to:
You own the data you contribute (your training logs, bloodwork uploads, nutrition entries, messages, posts, and media). You grant Fysigo a worldwide, non-exclusive, royalty-free license to host, store, process, copy, and display that content solely to operate the platform and provide the features you use — including showing your public profile, posts, and media to the audience you choose — and to sublicense those rights to our service providers acting on our instructions. The license ends when you delete the content or your account, except for copies kept under Section 12 or required by law.
Coaches own the programs, articles, offerings, and posts they create. Clients receive a limited license to access content their coach has shared with them through an active engagement.
If you send us feedback or suggestions, we may use them freely and without paying you or crediting you.
We respond to notices of claimed copyright infringement under the Digital Millennium Copyright Act. How to send a takedown notice or a counter-notice, and how to reach our designated agent, is set out on our Copyright Policypage. You can also report a public profile or post with the “Report” link on it.
Repeat infringers. We remove or disable access to material that is the subject of a valid notice. We terminate, in appropriate circumstances, the account of any member who repeatedly infringes others’ copyrights, and we may terminate after a single infringement.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the platform for your own training, coaching, or business with your clients. Fysigo and its licensors own the platform, its code, design, brand, and content (other than member content). All rights not expressly granted are reserved. We may change, suspend, or discontinue any part of the platform; if we discontinue a paid membership, we refund the unused part of a prepaid period.
Fysigo connects to services you choose, such as wearables, calendars, labs, Stripe, and Apple. We do not control them; their terms and privacy practices apply to your use of them, and you use them at your own risk.
Our Privacy Policy explains what we collect and how we use it, and forms part of these Terms. You agree to receive notices, receipts, and other account messages from us electronically; they satisfy any requirement that a notice be in writing. Promotional emails, such as renewal offers and coach invitations, carry an unsubscribe link and stop when you use it.
You may close your account at any time. Fysigo may suspend or terminate accounts that violate these Terms or that pose a security or legal risk to other users or to Fysigo.
On termination, Fysigo will retain account data for a 30-day soft-delete window so you can recover from a mistake, then perform permanent deletion subject to legal-hold or audit requirements. Sections 7, 8, and 13 through 18 survive termination.
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE FULLEST EXTENT PERMITTED BY LAW, FYSIGO DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, TITLE, AND NON-INFRINGEMENT. FYSIGO DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
You acknowledge that any reliance on information surfaced through the platform is at your own risk and that the platform is not a substitute for professional medical, mental-health, legal, or financial advice. Training carries a risk of injury; you are responsible for training within your own limits.
14.1 No consequential damages.TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GUTEN GROUP US HOLDINGS, INC. OR ANY OF ITS AFFILIATES, OR ANY OF THEIR RESPECTIVE OFFICERS, DIRECTORS, MANAGERS, MEMBERS, SHAREHOLDERS, EMPLOYEES, CONTRACTORS, OR AGENTS (TOGETHER, THE “FYSIGO PARTIES”), BE LIABLE TO YOU OR TO ANY PERSON CLAIMING THROUGH YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF OR DAMAGE TO DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, DOWNTIME, OR THE COST OF PROCURING SUBSTITUTE GOODS OR SERVICES, ARISING OUT OF OR RELATING TO THESE TERMS OR THE PLATFORM, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, BREACH OF STATUTORY DUTY, OR OTHERWISE, EVEN IF A FYSIGO PARTY HAS BEEN ADVISED OF, KNEW OF, OR SHOULD HAVE KNOWN OF THE POSSIBILITY OF SUCH DAMAGES.
14.2 Aggregate cap. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF THE FYSIGO PARTIES ARISING OUT OF OR RELATING TO THESE TERMS OR THE PLATFORM, UNDER ALL THEORIES OF LIABILITY COMBINED, SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS ACTUALLY RECEIVED BY FYSIGO FROM YOU IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) TEN THOUSAND DOLLARS ($10,000).
14.3 Basis of the bargain. These exclusions and limitations are an essential basis of the bargain, membership prices are set in reliance on them, and they apply even if a limited remedy fails of its essential purpose. Nothing in this Section limits your liability to any Fysigo Party.
14.4 What this Section does not do.Nothing in this Section limits, excludes, or waives (i) any right or remedy that cannot lawfully be limited, excluded, or waived before a dispute arises; (ii) any remedy under the California Consumers Legal Remedies Act, which may not be waived; (iii) statutory damages, civil penalties, or attorneys’ fees under non-waivable consumer-protection statutes; or (iv) the liability of a Fysigo Party for its own fraud or willful misconduct. Sections 14.1 and 14.2 otherwise apply to every claim, in contract, tort, or otherwise, to the maximum extent the law permits.
15.1 Mandatory binding arbitration.Except as provided in Section 15.4, any dispute, claim, or controversy arising out of or relating to these Terms or the platform, including their formation, validity, interpretation, performance, breach, termination, or enforceability, your relationship with Fysigo, and any question whether a dispute must be arbitrated (each, a “Dispute”), shall be resolved exclusively by final and binding arbitration administered by the American Arbitration Association (“AAA”). A Dispute brought by or against an individual using Fysigo for personal purposes is administered under the AAA Consumer Arbitration Rules; every other Dispute, including one with a coach using Fysigo in their business, under the AAA Commercial Arbitration Rules (including, where they apply, the Expedited Procedures). The arbitrator, and not any court, decides any dispute about the scope, applicability, enforceability, or formation of this Section. Judgment on the award may be entered in any court of competent jurisdiction. This Section may be invoked by each Fysigo Party.
15.2 Seat and hearings. The seat of the arbitration is Pinellas County, Florida. In a Dispute under the AAA Consumer Arbitration Rules, the hearing is held by video conference or telephone, at your election, unless you ask for an in-person hearing, which is then held in the county where you live or another agreed place. In every other Dispute, hearings are held in Pinellas County, Florida, unless the arbitrator orders video proceedings.
15.3 Arbitrator. A single arbitrator, appointed under the applicable AAA rules, who subject to availability is an attorney admitted in Florida with at least ten (10) years of commercial experience. The arbitrator applies the law named in Section 16 and has no authority to award damages excluded by Section 14.
15.4 Preliminary and injunctive relief. Either party may apply to the courts named in Section 15.6 for a temporary restraining order, preliminary injunction, or other interim relief — including to protect intellectual property or confidential information, or to preserve the status quo — pending the arbitration. Doing so does not waive arbitration. Final relief is reserved to the arbitrator.
15.5 Fees and costs.(a) The prevailing party in any Dispute is entitled to recover from the other party its reasonable attorneys’ fees, costs, and expenses, including AAA administrative fees, arbitrator compensation, and every other arbitration-related cost, incurred in the arbitration and in any related court proceeding. The arbitrator (or the court, in a proceeding under Section 15.4) determines the prevailing party and may apportion fees and costs. (b) In a Dispute under the AAA Consumer Arbitration Rules, Fysigo pays the AAA administrative fees and arbitrator compensation above the consumer filing fee those rules set, and an award of fees or costs against you is made only to the extent the law would authorize it had the claim been brought in court; where a statute limits fee-shifting (including California Civil Code Section 1780(e)), the statute controls.
15.6 Courts. Any proceeding under Section 15.4 and any proceeding to compel arbitration or to confirm, enforce, modify, or vacate an award shall be brought exclusively in the Circuit Court of the Sixth Judicial Circuit in and for Pinellas County, Florida, or, where federal jurisdiction exists, the United States District Court for the Middle District of Florida, Tampa Division. You submit to the personal jurisdiction of those courts and waive any objection to venue there.
15.7 Individual claims only; public injunctive relief. Each Dispute is arbitrated on an individual basis only, and the arbitrator may award relief only in favor of the individual party and only as needed to resolve that party’s claim. NEITHER PARTY MAY ARBITRATE A CLASS, COLLECTIVE, CONSOLIDATED, PRIVATE-ATTORNEY-GENERAL, OR OTHER REPRESENTATIVE PROCEEDING. Either party may seek public injunctive relief — relief whose primary purpose and effect is to stop unlawful acts that threaten future injury to the general public — in any court of competent jurisdiction; any such claim is severed, the individual claims are arbitrated first, and the court action is stayed until the award. If this waiver is held unenforceable as to a particular claim or remedy, that claim or remedy is severed and heard in court, and every other claim proceeds in arbitration.
15.8 Jury waiver. TO THE EXTENT ANY DISPUTE IS HEARD IN A COURT RATHER THAN IN ARBITRATION, YOU AND FYSIGO EACH KNOWINGLY, VOLUNTARILY, AND IRREVOCABLY WAIVE ANY RIGHT TO TRIAL BY JURY.
15.9 Law governing this Section. This Section is governed by the Federal Arbitration Act, 9 U.S.C. § 1 et seq., and, to the extent consistent with it, the Revised Florida Arbitration Code, Chapter 682, Florida Statutes. The arbitration is confidential, except that you may disclose your own Dispute and award, and disclosure is permitted as needed to enforce an award or as required by law, including arbitration-provider reporting obligations. This Section survives termination of these Terms.
15.10 Claims a statute keeps in court. Nothing in this Section limits your right to elect to litigate in court a claim covered by the Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act, 9 U.S.C. § 402, or any other claim a statute makes non-arbitrable despite this agreement.
These Terms, and any Dispute arising out of or relating to them or the platform, whether in contract, tort, statute, or otherwise, are governed by the laws of the State of Florida, without giving effect to any choice-of-law or conflict-of-laws rule that would apply the laws of another jurisdiction. The United Nations Convention on Contracts for the International Sale of Goods does not apply. This choice of law does not take away any protection of the mandatory consumer-protection laws of the place where you live that applies regardless of a contractual choice of law.
You agree to indemnify, defend, and hold harmless the Fysigo Parties from any third-party claim, demand, loss, liability, or expense (including reasonable attorneys’ fees) arising out of (a) your content, (b) your breach of these Terms, (c) your violation of any law or third-party right, or (d) for coaches, the services you provide to clients, except to the extent the claim arises from a Fysigo Party’s own fraud or willful misconduct. Coaches additionally indemnify Fysigo against any claim brought by their clients (see the Coach Acknowledgement). We may control the defense of any such claim at your expense, and you may not settle it without our written consent.
These Terms, the Privacy Policy, and the other policies they refer to are the entire agreement between you and Fysigo about the platform. If a provision is held unenforceable, it is enforced to the maximum extent permitted and the rest of these Terms stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign them freely.
California residents. Under California Civil Code Section 1789.3, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 N. Market Blvd., Suite N112, Sacramento, CA 95834, or by phone at (800) 952-5210.
Fysigo may update these Terms from time to time. For a material change, we post the updated version with a new version number and effective date, and tell members by email or in the app, at least 30 days before it takes effect. If you do not agree, cancel before the effective date; your membership then ends at the end of the period you already paid for. A change to Section 15 does not apply to a Dispute of which we had written notice before the change was posted.
